In the State of California, neither real estate brokers, nor real estate salespersons are licensed to provide legal advice concerning how to proceed in a real estate transaction. In fact, if you take a look at the bottom of each “California Association of Realtors®” form your real estate salesperson will ask you to sign, it states in all capital letters: “A REAL ESTATE BROKER IS THE PERSON QUALIFIED TO ADVISE ON REAL ESTATE TRANSACTIONS. IF YOU DESIRE LEGAL OR TAX ADVICE, CONSULT AN APPROPRIATE PROFESSIONAL.” The stakes are high in both residential and commercial transactions.
